Colorado's statewide bag fee implemented January 1, 2023

Starting January 1, 2023, Colorado House Bill 21-1162, also known as the Colorado Plastic Pollution Reduction Act, will require certain retail stores to charge a $0.10 fee on all single-use carryout bags. This will include both paper and plastic bags. 

The law was passed in an effort to reduce disposable bags in use in Colorado, which often end up in landfills or become litter. 

The Town of Eaton is working with our local retailers to establish which businesses will be required to start charging the bag fee. The bag fee requirement only affects businesses where either of the following criteria apply: 

  • The store has more than three retail locations
  • The store is part of a franchise, corporation, or partnership that has physical store locations outside of Colorado. 

Additionally, all food service and restaurant establishments are exempt from the law. The fee will not apply to customers that can provide evidence that they utilize federal or state food assistance programs.

The Town will continue to update residents as more details and information become available.
